CLUB R WINS!
A Major Trademark Milestone for Club Rendezvous®
After more than three years since our original trademark application, we are pleased to announce some fantastic news regarding the CLUB R trademark matter involving Toys “R” Us Canada.
The Canadian Intellectual Property Office (CIPO) has officially closed the opposition file after no formal Statement of Opposition was filed.
Our application to register CLUB R can now move forward toward registration.
A Little History
Club Rendezvous® has been part of the Canadian lifestyle community since 1983.
Alicia and Ryan have owned and operated the club since 2012, and throughout the years, CLUB R has become a familiar name among our members and throughout the lifestyle community.
On April 13, 2023, Club Rendezvous Inc. filed Canadian trademark application No. 2251999 to formally protect the name CLUB R.
Our full name, Club Rendezvous®, was already a registered trademark. The new application was intended to provide separate protection for our shortened name.
During the trademark application process, Next Century IPCO CAN ULC, a company associated with Toys “R” Us Canada, raised an opposition to our application.
Yes, you read that correctly.
A children's toy retailer was challenging the trademark application of a private, adults-only lifestyle club.
Two very different businesses, operating in two very different industries, serving two very different audiences.
The dispute eventually attracted national media attention in 2026.
And while the situation certainly gave us and many of our members a few laughs, we took protecting our brand seriously.
Then Came the Delays
The opposing company requested multiple extensions of time to formally proceed with its opposition.
Those requests resulted in the process continuing for months while we waited to see whether a formal opposition would actually move forward.
On August 6, 2026, CIPO granted an extension until September 30, 2026.
That extension was granted based on exceptional circumstances.
CIPO also specifically stated that it was very unlikely to favourably consider another extension based on substantially the same circumstances.
September 30 came and went.
No formal Statement of Opposition was filed.
The Official Outcome
On October 29, 2026, our trademark lawyer, Jennifer Marles, informed us that CIPO had issued official correspondence confirming that Next Century IPCO CAN ULC had not filed a formal Statement of Opposition.
THE OPPOSITION FILE HAS BEEN CLOSED!
After the objections, the extensions, the delays and the national media attention, the opposing company never proceeded with a formal opposition.
There was no contested hearing or decision on whether the trademarks were confusingly similar.
Instead, the opposition proceeding ended because the required formal Statement of Opposition was not filed.
This removes a significant obstacle from the registration process for CLUB R.
The Timeline
Club Rendezvous Inc. files Canadian trademark application No. 2251999 for CLUB R.
The trademark dispute involving Toys “R” Us Canada attracts attention from Canadian news outlets.
CIPO grants the opponent an extension until September 30, 2026, based on exceptional circumstances.
The final recorded deadline passes without a formal Statement of Opposition being filed.

The CLUB R trademark application moves forward toward official registration.
Where Does CLUB R Stand Today?
Our full business name, Club Rendezvous®, is already a registered trademark.
Our separate application to register CLUB R is still awaiting final registration.
However, the opposition proceeding that had been holding up the application has now officially concluded.
Our trademark lawyer expects the application to proceed to registration.
We look forward to sharing another announcement when that happens.
What Does This Mean for Members?
Absolutely nothing changes regarding our club operations.
Club Rendezvous continues to operate its Calgary location, host our signature events and welcome our members as usual.
Our future expansion plans also remain unaffected.
This matter has always been about protecting our brand identity. It was never a lawsuit against our business or a threat to our ongoing operations.
